Even though Tony Stewart may not face criminal charges from what happened at Canandaigua, he could still face a wrongful death claim. The reason is the different burdens of proof between a criminal case and a civil case. A criminal conviction requires the State to prove guilt beyond a reasonable doubt. In a civil negligence suit, the burden for the Plaintiff is the much lower proof by a preponderance of evidence. Thus, OJ was found not guilty of murder but required to pay millions for the wrongful death of the two victims.
