Sometimes cases are dismissed because the prosecutor realizes as the case progresses that the evidence is insufficient to prove guilt beyond a reasonable doubt. Other times, the prosecutor may dismiss a case after the defense attorney wins a significant motion such as a motion to exclude important evidence. The prosecutor may offer a diversion agreement that results in dismissal on the condition that the defendant successfully completes mental or substance abuse treatment.
The right attorney is required to expose factual and legal weaknesses in the State’s case prior to trial or to persuade the prosecutor that the defendant deserves a chance at treatment.
